Lawsuit filed against Tulare and California’s Kern County

The plaintiff, Jamyson Harris, filed a lawsuit against Tulare and Kern County in California. File number 18-cv-00699-LJO-BAM.
The accusations include kidnapping and child abuse.
In the fall of 1991, Jamyson, along with his brother and sisters, were taken to Tulare County Social Services in Porterville, California. By her mother’s roommates. Roommates falsely accused her mother of abandoning and abusing her children. While her mother was out of town she was moving into her new home. While she lived in a foster home with her sisters. Jamyson alleges that he was sexually abused by his adoptive mother. He was then given strong psychotropic drugs, expelled, and had to move from one foster home to another. Until he was finally sent to another county in the state of California.
Both Tulare and Kern counties do not deny or dispute what has happened thus far. Both counties are simply challenging the statute of limitations.
Pursuant to Government Code Section 911.6. In some circumstances, a late claim will be granted. My claim qualifies due to circumstances 1-3 of government code 911.6.
(b) The board shall approve the request when one or more of the following applies:
(1) The failure to file the claim was due to error, inadvertence, surprise, or excusable negligence and the public entity was not prejudiced in its defense of the claim by failing to file the claim within the time specified in Section 911.2.
(2) The person who suffered the alleged injury, damage, or loss was a minor during the entire time period specified in Section 911.2 for the filing of the claim.
(3) The person who suffered the alleged injury, damage, or loss was physically or mentally incapacitated for the entire time specified in Section 911.2 for the filing of the claim and because of such incapacity did not file a claim during that time.
The plaintiff alleges that they were placed in foster care through mistake and negligence. Because his mom’s roommates lied to the county and the county social workers didn’t do their job.
“They just accepted the lie and forced us to accept the lie.” Jamison said. “We didn’t know our 4th and 14th Amendment rights were being violated. We were just minors, defenseless, and our mother was gone. Nobody cared. One side wanted us to leave. The other side was getting paid to do it. There was no real due process for our mother,” Jamyson continued.
Jamyson is currently working with his therapist to gather evidence to support circumstance number three. Jamyson claims that she was mentally incapable of filing a claim on time. Because according to her therapist the trauma of being kidnapped, sexually abused and placed on medication. She disassociated herself from what happened and the damage was so great. By the time Jamyson was taken off his meds. The memory of him was so scattered that he had completely forgotten why he was really in a foster home.
