It seems that a lot of questions are being asked about whether or not delta8 THC is cannabis in the state of Minnesota. While some argue that it is only illegal in view of the fact that it contains a high concentration of THC, the state government maintains that it is entirely legal, and in fact, fully supported by the state. It is this legal stance which allows for the production, possession and consumption of products containing CBD as well.

Simply put, it is technically not legal, but the same laws that apply to cannabis are applicable here. In terms of federal law, products derived from cannabis are federally legal, because the 2018 Farm Bill legally classifies it as a product derived from the cannabis plant. The bill officially labels all hemp products derived from cannabis as “cultivated plants”. This includes hemp supplements and products such as oil and waxes, butts, papers, stalks and seeds. In addition, the medical card act specifically defines the medical use of cannabis by allowing patients with various diseases and illnesses to legally consume cannabis if their physician recommends its consumption.
In light of this new legislation, it may be tempting to assume that cannabis is completely legal in Minnesota, but this is simply not the case. While patients can obtain a doctor’s prescription for medicinal marijuana under the auspices of the new legislation, it is important to understand that this authority is still largely untapped and may be subject to abuse. In addition, although the federal government has taken an official stance against the cultivation and distribution of CBD, it has yet to legalize or regulate CBD for recreational use, leaving it up to the states to solve these issues.
Is Delta-8 THC Potable?
One way to determine is whether or not it is legal to buy delta-8 thc in Minnesota is by understanding whether or not it is currently legal to drive a car in Minnesota. It is currently illegal to operate a vehicle under any circumstance, but this does not apply to medical marijuana. Although not formally legalized, it is believed that the state of Minnesota will begin issuing drivers with identification cards similar to those issued for drivers who possess a medical card, and will likely implement a tax system similar to that already in place in Wisconsin and Colorado. While it is currently illegal to sell or share cannabis, it is considered less harmful than alcohol, and therefore may be legally purchased and used by adults over the age of 21 living in the state of Minnesota.

Proponents claim that the plant is not currently considered illegal by federal law and that there is no reason why it should not be legal in Minnesota once it is fully legalized. Opponents argue that the plant is highly addictive, has no effective therapeutic benefit, and is an illegal drug in any way.
